AbandonmentIt seems that in the past two or three years I have heard more and more clients tell me that they would like to move out of the marital residence but they are afraid that they will be charged with "Abandonment". There is no such thing as "Abandonment" in our divorce law. It is a concept that we learned about in law school which determined, for example, which party had proper title to an umbrella that was discarded in a bus station waste receptacle. Was it the person who threw away the umbrella or the person who fished it out of the waste bin? A downpour may have made this a very critical issue.
